1. Acceptance of Terms

By accessing or using Orb ("the Service"), operated by BiryaniLabs, you agree to be bound by these Terms & Conditions. If you do not agree to these terms, do not use the Service.

2. Description of Service

Orb is a hosted artifact service that converts AI-generated content — including webpages, markdown documents, and flowcharts — into private, shareable links. The Service is accessible via byorb.app and through our API.

3. Account Registration

You must create an account to use certain features of the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep it updated.

4. Acceptable Use

You agree not to use the Service to:

• Upload, host, or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Distribute malware, phishing pages, or any content designed to harm or deceive others
• Infringe on the intellectual property rights of any third party
• Attempt to gain unauthorized access to the Service, other accounts, or connected systems
• Use the Service to send unsolicited communications or spam
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service in any way that violates applicable laws or regulations

5. Content Ownership and License

You retain ownership of all content you create or upload through the Service. By using the Service, you grant us a limited, non-exclusive license to host, store, and display your content solely for the purpose of providing the Service (e.g., rendering artifacts and making them accessible via shareable links).

We do not claim ownership of your artifacts or use your content for training machine learning models.

6. Shareable Links

When you generate a shareable link for an artifact, anyone with that link can view the content. You are responsible for managing who you share links with. We are not liable for any unauthorized access resulting from shared links.

7. API Usage

Access to the Orb API is subject to rate limits and usage restrictions based on your subscription plan. You agree not to abuse, overload, or reverse-engineer the API. API keys are confidential and should not be shared publicly.

8. Subscription and Payments

Orb offers both free and paid plans. Paid subscriptions are processed through DodoPayments. By subscribing to a paid plan, you agree to pay the applicable fees. Subscriptions renew automatically unless cancelled before the renewal date. Refunds are handled on a case-by-case basis.

9. Free Plan Limitations

The free plan includes a limited number of saved artifacts. Once the limit is reached, you will need to upgrade to a paid plan or delete existing artifacts to create new ones.

10. Service Availability

We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may suspend or discontinue the Service (or any part of it) temporarily for maintenance, updates, or unforeseen circumstances. We will make reasonable efforts to notify you of planned downtime.

11. Content Moderation

We reserve the right to review, remove, or disable access to any content that violates these terms or that we deem harmful, without prior notice. Repeated violations may result in account suspension or termination.

12. Intellectual Property

The Service, including its design, logos, and underlying technology, is the property of BiryaniLabs and is protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without prior written consent.

13. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or meet your specific requirements.

14. Limitation of Liability

To the maximum extent permitted by law, BiryaniLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of the Service.

15. Indemnification

You agree to indemnify and hold harmless BiryaniLabs and its affiliates from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these terms.

16. Termination

We may suspend or terminate your account at any time for violations of these terms. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately, and we may delete your content after a reasonable retention period.

17. Changes to These Terms

We may update these Terms & Conditions from time to time. Continued use of the Service after changes are posted constitutes your acceptance of the revised terms. We will notify you of material changes via email or through the Service.

18. Governing Law

These terms are governed by and construed in accordance with applicable laws. Any disputes arising from these terms or the Service shall be resolved through good-faith negotiation first, and if unresolved, through binding arbitration.
